Terms and Conditions Policy Agreements

Shipping Policy

  • We no longer meet "need by" dates. No exceptions. Please order in accordance with the shipping times listed. 

  • We do not ship to P.O. Boxes. We Only Ship to Physical Addresses. 

  • Your order will leave our facility within 28 days from date of purchase. Transit time not included. 

  • Orders are created, cut, and shipped in the order in which they were received.

Order Addition Policy for Wholesale Vendors

Order additions MUST be turned in with 48 hours of the initial order number. 

You MUST leave the initial order number at checkout or send to us via email when the second order is placed. 

Orders placed against this policy will be subject to a secondary invoice for additional shipping charges. The secondary invoice (if required) must be paid before your order will be processed and shipped.

Collection Policy

When purchasing items from the Home Décor or Ready To Ship collections you may not add items from any other collections to the same order. 

​

If you place an order with any item from one of these collections in addition to any other other collection we will reach out to you with adjusted shipping or refund your order and ask you to split it up into two invoices. This helps keep our productivity line in order.

​Return Policy

The only time we will accept returns or send refunds or replacements is if your items arrive broken or you receive items you did not order. We will not accept returns on custom orders. Please double check all custom options, spelling, colors, etc.… before checkout.

 

For any damaged products, reach out to us within 14 days of the date you receive the product, and we will exchange it or offer a refund. If you are still able to use the damaged products, we will not issue a refund or send replacements.

 

Coaching/Training/Booking Policy Agreement

  • Although you do choose a specific date/time when you request to book that does not guarantee your selected date/time will be approved. If that date/time doesn’t work for our schedule we will reach out with some other options and go from there.

  • We do not offer refunds for coaching calls or training sessions.

  • If you need to reschedule your coaching call you must give us at least 6 hours’ notice or you will still be billed for the time set aside for your call.​

  • An invoice for your coaching call will be sent after your date/time has been finalized but before your meeting begins. Your invoice must be paid before your meeting begins.

Privacy Policy

We receive, collect and store any information you enter on our website or provide us in any other way. We also collect personally identifiable information (including name, email, password, communications).

When you conduct a transaction on our website, as part of the process, we collect personal information you give us such as your name, address and email address. Your personal information will not be sold to anyone else.

We collect such Non-personal and Personal Information for the following purposes:​

  • To provide our Users with ongoing customer assistance and technical support;

  • To be able to contact our Visitors and Users with general or personalized service-related notices and promotional messages;

  • To create aggregated statistical data and other aggregated and/or inferred Non-personal Information, which we or our business partners may use to provide and improve our respective services; 

  • To comply with any applicable laws and regulations.

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

This website offers visitors a variety of products, services, and memberships. When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. 

 

Member Policy:

We may permanently or temporarily terminate or suspend your access to the service, membership, groups, or site without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations.

You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review this page periodically. Your continued use of the Website or our service after any change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

If you agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you do not want to receive such promotional materials or notices – please notify us or click unsubscribe on your latest message. All information provided by subscribers, customers, members, or viewers will be kept confidential and not be sold to any third party sources. 

 

Customer Behavior Policy

Whippoorwill Charm can choose to, without prior notice, do business or not do business with any customer or small business as we see fit.

We do not tolerate foul language, rude behavior, trolling, or design/image stealing on our site, in our emails, or on any of our social media platforms.

We will exercise our right to block and refuse business with any customer who takes part in any of these behaviors. 

We may, without prior notice, change the services/products; stop providing the services/products or any features or options of the services/products we offer; or create limits for either.

We may permanently or temporarily terminate or suspend access to the services or products without notice and liability for any reason, or for no reason.
